Elviria Hills · Marbella
House terms
DRAFT for Claudia's review. Plain-language terms written for this preview. Please read them through, and have them checked by your Spanish gestor or lawyer before the site goes live.
Thank you for choosing to stay at Elviria Hills. These terms explain what you can expect from us and what we ask of you. They apply together with our Payment & Cancellation policy.
1. The apartment and your booking
- Elviria Hills is a holiday apartment (vivienda con fines turísticos) registered with the Junta de Andalucía, licence VFT/MA/61497. It is let for holiday stays only.
- Your booking is confirmed once Claudia has confirmed it in writing and your 30% deposit has been received.
- The booking is for up to 4 guests, named in your request. Please ask before bringing anyone else to stay.
- Check-in is at 2pm, or at another time agreed in advance. Your local host will make a special trip to welcome you, so please arrange your arrival time beforehand.
- Check-out is by 10am, unless we agree otherwise.
2. Guest registration (required by Spanish law)
- Spanish law (Real Decreto 933/2021) requires us to collect and register details of all guests, including passport or national ID details where applicable.
- Please provide the required information before or at check-in. Under our booking terms, failure to provide this information will result in entry being refused, and no refund will be issued.
- We use these details only for this legal registration and for your booking, and keep them safely as the law requires.
3. House rules
Claudia to confirm the final list. For now:
- No pets.
- No smoking inside the apartment, including vaping and e-cigarettes.
- No parties or events.
- Please keep noise low, especially at night, out of respect for the neighbours.
- Please follow the pool and community rules of Elviria Hills.
- Please lock windows, the apartment door and the entrance downstairs when you go out.
- No towels or laundry over the balcony rails.
- Please turn off the air conditioning when you go out, and keep windows and doors closed while it is on.
- Please return the keys as agreed at check-out.
4. Looking after the home
- We ask you to treat the apartment as you would your own home.
- Guests are responsible for any loss or damage to the apartment, its contents or the community areas caused during their stay, by them or their visitors, beyond normal wear and tear.
- Please tell us about any breakage or problem as soon as possible. Accidents happen, and it is always easier to sort things out early.
- The cost of repair or replacement may be taken from the €300 security deposit. We will always explain any deduction and show you the cost. If the cost is higher than the deposit, we will agree the difference with you.
5. Our responsibility
- We take care that the apartment is clean, safe and as described.
- As far as Spanish law allows, the owner is not responsible for loss of or damage to guests' belongings, or for accidents or injury, unless caused by the owner's own fault or negligence. We recommend travel insurance that covers your belongings.
- The pools, gardens, gym, tennis courts and other community facilities are run by the Elviria Hills community, not by us. Please use them with care and at your own risk, and keep an eye on children at all times.
- Occasionally things outside our control happen, such as a power or water cut, community works or a pool closed for maintenance. We will let you know as soon as we can and do all we can to help.
- Nothing in these terms limits your rights as a consumer under Spanish and EU law.
6. If we have to cancel
This is very unlikely. If we ever have to cancel your stay, you will receive a full refund of everything you have paid.
7. Complaints
If anything is not right, please tell Claudia straight away so she can put it right. As Andalusian law requires, official complaint forms (hojas de quejas y reclamaciones) are available on request.
8. Law
These terms are governed by Spanish law.
